1. ACCEPTANCE OF TERMS

Welcome to Infinite Mind (無限心). By accessing our website, registering for an account, or participating in any of our online or in-person services (including but not limited to meditation, yoga, Chan (禪) living, and traditional martial arts (傳統武術) training), you (“User,” “Participant,” or “you”) expressly agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms in their entirety, you must immediately cease using our website and services.
 

2. NATURE OF SERVICES & MEDICAL DISCLAIMER

The services, content, and teachings provided by Infinite Mind (無限心) are strictly for educational, wellness, and personal development purposes.
  • Not Medical or Psychological Advice: Nothing on our website or in our training sessions constitutes medical, psychiatric, psychological, or therapeutic advice. Our practices are not a substitute for professional healthcare.
  • Mandatory Medical Clearance: You expressly represent and warrant that you have consulted with a qualified healthcare provider and obtained full medical clearance to participate in physical activities (including yoga and traditional martial arts (傳統武術)) and introspective practices (including Chan (禪) meditation).
  • Pre-existing Conditions: It is your sole responsibility to inform your instructor of any physical injuries, psychological conditions, or limitations prior to participation.
 

3. ASSUMPTION OF RISK

You acknowledge and agree that participation in Infinite Mind (無限心) activities carries inherent risks, which may include but are not limited to:
  • Physical Risks: Sprains, strains, fractures, dislocations, cardiovascular events, or other serious physical injuries resulting from yoga, traditional martial arts (傳統武術), or physical conditioning.
  • Psychological/Emotional Risks: The emergence of repressed emotions, psychological discomfort, or emotional distress during deep meditation, Chan (禪) living practices, or introspective exercises.
  • Environmental Risks: Risks associated with in-person training locations, travel, or outdoor activities.
 
You voluntarily and expressly assume ALL risks, known and unknown, associated with your participation in any Infinite Mind (無限心) services, whether online or in-person.
 

4. COMPREHENSIVE WAIVER AND RELEASE OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY IRREVOCABLY WAIVE, RELEASE, AND DISCHARGE Infinite Mind (無限心), its affiliates, officers, directors, employees, contractors, instructors, and agents (collectively, the “Released Parties”) from ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or to any property belonging to you, whether caused by the ordinary negligence of the Released Parties or otherwise, while participating in such activities, or while on the premises of Infinite Mind (無限心) or using its online platforms.
 
This waiver includes, but is not limited to, claims for direct, indirect, incidental, consequential, special, exemplary, or punitive damages, loss of profits, or emotional distress.
 

5. INTELLECTUAL PROPERTY RIGHTS

All content, methodologies, frameworks, curricula, and materials provided by Infinite Mind (無限心), including unique syncretic cultural teachings, Chan (禪) frameworks, and traditional martial arts (傳統武術) lineages, are the exclusive intellectual property of Infinite Mind (無限心). You may not record, reproduce, distribute, modify, create derivative works from, or commercially exploit any content, sessions, or materials without express prior written consent. Unauthorized sharing of login credentials for online services is strictly prohibited.
 

6. USER CONDUCT AND TERMINATION

Infinite Mind (無限心) serves a diverse community, including military veterans, business professionals, and individuals seeking profound personal transformation. We maintain a strict standard of respect, discipline, and safety. We reserve the right, at our sole and absolute discretion, to refuse service, terminate your access to the website, or dismiss you from any in-person or online session without refund if your conduct is deemed disruptive, disrespectful, unsafe, or in violation of these Terms.
 

7. ONLINE SERVICES DISCLAIMER

Our online platforms, digital content, and virtual training sessions are provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that our online services will be uninterrupted, secure, or free of errors, viruses, or other harmful components. We are not liable for any technical failures, internet connectivity issues, or data breaches that may occur during your use of our digital services.
 

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to reasonable attorney’s fees) arising from: (a) your use of and access to the Infinite Mind (無限心) website and services; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including without limitation any intellectual property or privacy right.
 

9. SEVERABILITY

If any provision of these Terms (including any part of the liability waiver) is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The parties agree that the court shall modify the unenforceable provision to the minimum extent necessary to make it enforceable while preserving the original intent of comprehensive liability protection.
 

10. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Hing Kong SAR, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Hong Kong SAR, and you hereby consent to personal jurisdiction and venue therein.
